These general terms and conditions apply to the sale of a kitten as a companion animal.
1.1. These terms and conditions apply between Cats of Kruger AB, company registration number 559517-3369 (the "Seller"), and the person purchasing the kitten (the "Buyer").
1.2. The Seller operates as a limited liability company and applies the Swedish Consumer Sales Act (2022:260). All prices include 25 % value added tax.
1.3. By paying the deposit and/or signing the purchase agreement, the Buyer confirms that they have read and accepted these terms and conditions in their entirety. The payment methods are set out in these terms and conditions and are accepted by the Buyer upon payment of the deposit.
2.1. When reserving a kitten, a deposit of SEK 3,000 must be paid. The deposit is payable exclusively via Swish in accordance with the payment details provided by the Seller.
2.2. If the Buyer cancels the purchase, the deposit will not be refunded, as it is intended to cover the Seller's administrative costs, lost sales time and the work involved in arranging a new reservation.
2.3. If the kitten does not pass the veterinary examination prior to delivery and the Buyer does not accept any remarks in writing, the deposit will be refunded in full.
3.1. Final payment of the remaining purchase price must be made by invoice or bank transfer and must be received by the Seller no later than the banking day before the agreed collection date.
3.2. Final payment via Swish is not accepted.
3.3. The kitten will not be released upon presentation of a payment receipt. The payment must have been credited to the Seller's account.
3.4. If final payment is not made or is made late, the Seller is entitled to cancel the purchase and retain the deposit as compensation for breach of contract.
4.1. Companion animal The cat is sold exclusively as a companion animal. The Seller provides no guarantees regarding future show results or physical development.
4.2. Neutering If the cat is not delivered already neutered, the Buyer undertakes to have the cat neutered no later than at six (6) months of age. A certificate from a licensed veterinarian must be sent to the Seller without delay.
4.3. Prohibition on breeding The cat may under no circumstances be used for breeding, including for a single litter. A contractual penalty of SEK 30,000 is payable in the event of a breach of this provision.
5.1. The cat is delivered with a veterinary examination certificate that is no more than seven (7) days old at the time of delivery.
5.2. A defect means only a condition that materially affects the cat's function as a companion animal. Minor cosmetic deviations, malocclusion or similar conditions that do not require surgery or cause adjustment difficulties do not constitute defects within the meaning of the law.
5.3. The Buyer has a duty to inspect the cat upon collection. Conditions noted in the veterinary examination certificate cannot subsequently be invoked as defects.
6.1. Latent defects The Seller is liable for latent defects in accordance with the Swedish Consumer Sales Act for a period of three (3) years from the date of delivery. A latent defect means a serious defect that existed at the time of delivery but could not have been detected during a thorough veterinary examination.
6.2. Insurance – primary responsibility From the date of delivery, the cat must be continuously covered by veterinary care insurance with Agria Djurförsäkring. The insurance must be the first source of compensation in the event of illness, injury or a suspected latent defect. The Seller's liability arises only to the extent that compensation is not provided by the insurance company and to the extent required by mandatory law.
6.3. Financial limitation The Seller's financial liability is in all cases limited to the cat's original purchase price. No compensation is provided for indirect costs, including but not limited to travel expenses, loss of income, medication, special food, insurance deductibles or other consequential costs.
7.1. If a latent defect is suspected, the Buyer must notify the Seller of the complaint in writing without delay and no later than fourteen (14) days after the defect was discovered.
7.2. A written veterinary opinion from a licensed veterinarian is required to substantiate a latent defect. As far as possible, the parties must consult each other regarding the choice of veterinarian. The cost of the examination is initially paid by the Buyer.
7.3. No treatment, other than emergency life-saving care, may be commenced without written approval from the Seller or the insurance company if a claim for compensation is to be made.
8.1. The Buyer is responsible for registering the cat in the Swedish Board of Agriculture's cat register immediately upon taking possession.
8.2. If the Buyer can no longer keep the cat, the cat must first be offered back to the Seller, which means that the Seller must first be contacted for consultation. The Seller has a right of first refusal to repurchase the cat but is not obliged to do so.
8.3. If the Seller chooses to exercise the right to repurchase, the price will be based on the cat's age and condition, but will not exceed 50 % of the original purchase price up to 12 months of age and thereafter no more than 25 %. If the Seller declines to repurchase the cat, the new home must be approved by the Seller before the transfer takes place.
9.1. Personal data is processed for the purpose of fulfilling this agreement and is retained in accordance with applicable legislation, including the Swedish Accounting Act. The data is stored for seven (7) years. The Buyer has the right to request access to, correction of or deletion of personal data in accordance with the General Data Protection Regulation (GDPR). Further information is available from the Swedish Authority for Privacy Protection (IMY).
10.1. Any dispute must primarily be resolved by mutual agreement. If legal proceedings become necessary, the dispute will be decided by a Swedish court of general jurisdiction, with Helsingborg District Court as the court of first instance.
